User Agreement (Terms of Service)

Welcome to Dressedly ("the Service"). Please read these Terms of Service ("Terms") carefully before using the website and application operated by the Dressedly developer ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Nature of the Service (Beta Warning)

You acknowledge that Dressedly is a hobby project and is currently in a BETA testing phase. This means:

• The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, whether express or implied.
• The Service may contain bugs, errors, or other problems that could cause system failures or data loss.
• We do not guarantee that the Service will function uninterrupted, secure, or available at any particular time or location.
• We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice or liability.

2. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must satisfy the minimum age requirement of 13 years old to use this Service.

3. User-Generated Content

You retain full ownership rights to the photos and data you upload to Dressedly. However, by uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display your content solely for the purpose of:

• Providing the Service (e.g., generating AI cutouts, storing your wardrobe).
• Improving the Service and our AI algorithms (using anonymized data).
• Debugging and troubleshooting technical issues.

You represent and warrant that the content you upload does not violate the privacy rights, publicity rights, copyrights, or other intellectual property rights of any person.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER OR DRESSEDLY BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

Because this is a free hobby project, you agree that your sole remedy for any dispute with Dressedly is to stop using the Service and delete your account.

5. Indemnification

You agree to defend, indemnify, and hold harmless the Dressedly developer from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

6. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material (spam).
• To impersonate or attempt to impersonate the developer, another user, or any other person or entity.
• To upload content that is illegal, sexually explicit, harmful, or offensive.

7. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. You may also delete your own account at any time via the account settings, which is irreversible.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
